Controversial Bill of Information Technology  Being Presented in the Parliament

The controversial bill drafted for systematising the issues related to the information technology is going to be submitted in the parliament. The bill, which was passed by the Development and Technology committee of the parliament on 13 Poush, 2076 in spite of the main opposition party, Nepali Congress' different version, is scheduled to be presented in the meeting of the House of Representatives on Thursday.

Since the 'different version', claimed by the Nepali Congress, is not included in the draft of the bill, the source says, the main opposition has planned to raise its argument in the House after the bill is presented for discussion. Congress says if the bill gets passed as it is from the House, it will abuse the fundamental rights of the people by narrowing down the provision of the freedom of speech.

In the bill, very strict provisions are drafted like if somebody posts anything irritating, teasing, humiliating, inciting hatred and enmities, degrading moral character or insulting other people on the social media, that would be taken as a crime liable for hard-line punishments like up to 5 years imprisonment and fine up to the amount of 15 hundred thousands NRs.

Another significant issue in the draft of the bill is the provision that requires the social networking sites, like Facebook, Twitter etc, to get registered in Nepal, following the given process, in order to enable themselves to provide service in the country's territory.

Similarly, another controversial subject in the bill is about the provision in Article 81 in which it is mentioned that one must obtain permission from the ministry of information and communication before using softwares, electrical systems or equipments.

Nepali Congress has kept its different version on the proposed provisions saying the provisions not only abuse the fundamental rights of the people, they also badly affect the justice and social system because such provisions are against the principle of the criminal justice and the freedom of expression as well. Experts of the law and justice say some provisions in the bill are not only contrary to the fundamental rights written in the constitution, they also ridicule the universal principle of criminal legal system.
